ICC Articles

I found the article by DeGuzman provided the reader with the most persuasion, because while the international criminal court has faced some backlash in recent years for seeming ineffective in attempting to disband international criminal cases, the author has pointed out that is in a relatively new institution that has been working to adapt their work and institutional designs in order to become more effective. The author notes that it is not a surprise that it has not been able to overcome political realities, since it has only been established since 2002. In fact, she argues that they have been able to accomplish in the short period of time since then. I find this most persuasive given the fact that most people are unaware of how much effort it takes to put these trials into effect.

The International Criminal Court has been able to gain the support from most of the worlds states, which has been beneficial but the reliance on state and actor cooperation has made for many challenges given the fact that it is an international institution. Other challenges such as administrative function or defense have been issues that the International Criminal Court have been aiming to do organize better. While there is little support for the ICC, there is the author notes that they have prosecuted important social issues such as the recruitment of child soldiers, and crimes of sexual violence which creates an impact on these social injustices. This point is quite persuasive as it displays major impacts the court has made in recent years.

The author notes that its foundation and symbolic value are the International Criminal Court is one of the greatest strengths, and why it is so crucial to our society. The article states that International Criminal Court has “sent strong messages that the world condemns such crimes.” While this may not be 100% preventative of such heinous crimes, it will send a message that those who contribute or act upon these crimes will in persecuted, which is worth the government fundings and contributes that goes into the organization.
